The function of the mediation board would be to stand between homeowners facing foreclosure and the lenders and work out solutions based upon the circumstances and the specific requirements of both lender and borrower. . The present foreclosure system, banks have all the power. The lenders have none. The banks have high-power attorneys. The super-wealthy who own the banks have manipulated the laws completely in their favor. They couldn't care less about the borrower. The lender gets first money in a foreclosure. . Mediation is about making resolution more important that fighting. The goal is to avoid courts and lawyers because fighting is very expensive and time-consuming, and the lawyers are usually the only winners. The goal in mediation is to eliminate conflicts and to make both sides winners. The Mediator's Job: The mediator's job is to resolve disputes -- to find fair, just and equitable solutions that are not necessarily following the wishes of either side. What side is the mediator on? --- The mediator is on both sides. He or she is on the side of resolution. The objective is to reach a settlement that is as near as possible to what both sides want. . |
